[Solved] Who pays when a child stays with either parent

Looking for info., both my kids stayed with their mum but now the oldest has decided to stay with me. Initially I paid maintenance for both but now that one is with me and the other is with my ex., do we pay and claim maintenance of each other or does that just cancel everything out ?

Hi there

You can both open a case with the CSA, you would be entitled to the child benefit for a child each and also maintenance from each other, but as this is worked out as a percentage of salary, if one of you earned more than the other then the higher earning parent would have to pay more maintenance.

It would be much easier to come to an arrangement between yourselves about how maintenance is paid, or indeed if as you say, the fact that you have one child each, that you agree to cancel it out and each of you just claim the child benefits and tax credits for one child each.
