What would you do if CAFCASS did not send you the report before the first hearing not even at the hearing, and the only way you got to see it was by reading the other side's copy??

I think it is disgraceful, I had no time to prepare or even think straight, I felt that I had to agree on her proposals or wait another 6 months for a full hearing and my daughter grows further apart from me.....i wasn't worried about the allegations in the report, they were lies that i could easily prove as lies in a full hearing.....but I should have been given the chance to prepare my defence to them and wasn't.

...there's not a lot you can do, did you bring this up in court? Are you still going to a final hearing? Were you not asked to file a statement to respond to the allegations?

You can prepare a statement to respond to the allegations and attach your evidence and send it in ready for the next hearing. Ask the court to send you a copy of the CAFCASS report for your records.

I don't know what to do, I did not have a lawyer. I agreed to the offer of every other weekend and one evening in the week but I wanted 50/50 shared residency.
The only reason I accepted without a fight was because I haven't seen my daughter for more than a few hrs in 3 months and I thought it would take another 6 months for a hearing. I have all the evidence to rebut the allegations.
So now there is no other hearing.....and Im kicking myself for not holding out. But we have a starting point and I suppose that she cannot rely on false allegations if there is a future hearing as I will have been seeing my daughter as the court order says.
I guess I can only go back to court if she breaks the order.

...you can apply to the court for a variation at a later date. In the meantime you now have an amount of contact that will enable you to have some quality time with your daughter. It might not be what you wanted but it is a vast improvement on what you were getting.
