Hi what is a directions hearing and will there be a final descion made on if I will start seeing my son again? I have sent the c79 form off to court and they have sent me a copy back with a date. I'm self repping so not sure what will happen.
Thanks
The Directions hearing is a court sitting when the Judge/Magistrates directs in which way the case will go, nothing will be decided on that date as it's a long drawn out process I'm affraid.
If there is safeguarding issues with the children cafcass will file a report then the Judge will decide if certain condtitions have to be met for the next hearing, it might be worth while asking for interim contact as it may be a while before you see your kid/kids.
For example in my case they set a review hearing for tomorrow at the directions hearing 3 months ago, the judge refused me interim contact and I've not seen my girls for 8 [censored] months, they also asked me to do a drug test a seperated parents information program, a letter from my gp saying I went to him for help giving up the weed, my ex didn't have to do anything it's stupid they also requested cafcass done an s7 report and background checks on me from the police ect and from my ex's health visitor.
So it's basically a meeting with all parties to decide where the case is going to go check the stickies at the top of the legal eagle section I've done one for attending court 🙂
Slim 🙂
...if she raises safeguarding concerns as the reason for breaching the contact order then they may well ask CAFCASS to make a report, in which case contact may be delayed.
It's a suck it and see situation, but if she has no real grounds for stopping contact then the court may just plough ahead with it.
Thanks mojo and slim her reasons are I'm picking and choosing the dates. Which I have a txt message saying the date as proof I had something planned for only week only! The other is he doesn't want to see me which is complete nonsense, so you think the court could allow me access on the 1st date I'm given?
Cheers dude 🙂
But in you're opinions do you think the judge will see these as good enough reasons in the first hearing to stop me seeing my son?
Hi - I am waiting for a direction hearing date.
I submitted the C100 forms 7 days ago and everyday I wait for the call or message from my ex when she receives notification that I have filed for a court order.
How long did it take from the date you sent the forms to get any correspondence back from the court?
Thanks
V
No more than a week mate mine was about 5working days or less I think the cheque has to clear of £215.00 before they give you the date. I'm the same mate once my x got the forms she was phoning and ringing saying I'm lieing and calling me names. It defo gets a reaction off them when they get a letter through the door
