Hi there,
I'm a dad who pays maintenance for my daughter and I'm stuck in a situation where I'm not sure what to do ?
I've contacted my ex partner now over the last 3 days via text message with regards to if I can pick my daughter after school to have her for a few hours today ( as I hav t seen her in a week due to her being away on holiday with her mum's family).
Now.....
I've not heard anything back from my ex so what do I do ?
If I don't pick her up as I've asked I'll most likely get called every name under the sun !, but if I do pick her up without hermums permission ( even though we're in a shared care agreement), could I end up getting in to trouble - for example, if my ex decided I wasn't aloud etc !
What rights do I have as a dad to have access to my daughter ?
Hi there
Is your shared care agreement by court order, or an informal agreement reached between the two of you?
Perhaps send her a text and say that as you haven't heard you're assuming it's ok so you will pick her up.
You can't get in trouble as such, but if your agreement is informal and you don't have a court order then she could just stop you seeing her to illustrate her control, or worse case scenario she could call the police. However if you have Parental Responsibility I doubt the police would do anything else but check she is safe and well.
