.if all wifes verbal or phone complaint is taken seriously than most of the husbands should be in police custody /Jail/crimianl offenders...how UK police verify the breach of NMO occured outside UK ...can anyone throw some light .below are my questions ...
a) If the breach of NMO has taken place outside the country dont you think locally (in our home country) there needs to be a complaint registered and enquiry made by police with accused (me) and that need to be proved locally and then that fact can be produced in UK court as breach of NMO
b) but for an NMO issue by UK court why some other country will consider that and register complaint as that NMO might not be applicable in that country..usually in my country police will not simply register complaint as that would be additional investigation for them to work/prove.
c) Also as a caveat I can take letter from home country solicitor while returning back to UK Stating that no complaint / breach has proved in my country and he can be contacted by UK police if required for any clarification regarding me breaching NMO or any complaint from my wife etc .. this would save you from false NMO breach aquisition....do you agree with me???
.. It's quite complex for sure, I wouldn't like to give an opinion without knowing all of the facts. I think you'd be better off directing your questions to a lawyer here and in your country of origin.
As I said before, there are exising protective orders between the EU and UK in place, which indicates that th UK authorities are aware this can be a problem...if you were to approach her or break the terms of the NMO whilst abroad, the court may not have any authority to have it enforced in your country as it's outside of the EU, but they may take account of it if she brings it up to them, say for instance, when you apply for other orders.
Perhaps you could talk to the police here and ask them what the parameters are as far as the existing NMO is concerned.
Thanks for the reply ..
I agree this is very complicated as court has not detailed anything regading the Juridistriction and how breach need to considered...at the end being a false victim its my headache to receive and keep looking for all unsolvable answers..
My personal opinion ( sorry if i am not condemning anything in general here)
- that police will only follow checklist and dont use any brain.....last time i dint receive the NMO by post and within the time i have texted hi/hello messages to my wife ...my wife made false allegation that i have sent her theatening message ...then police simply came to my flat in the early morning and took me into custody ...probably they could have verified ..what kind of message it was ...was it really threatening ...when did they sent me NMO ...what date i received and who received etc...after keeping in custody for more than 15 hours they found that some one else received the court order on behalf of me and i received from them after 5 days ...finally they discharged the case...in the whole context i lost 3 additional days without having mobile phone as they kept it under custody ..with all these mess ....the final implication is that i went to court hearing ( i had only a week time to appear for hearing after receiving NMO) without any preparation and could not give any reply in writing ....
-this is a real situation for an husband who really loves his wife and kid...i really have to say that NHS doctor ..child care ..social care messed my life and torn into pieces ...i will write how in another post how things went wrong and how people in between used my situation to run their cottage industry ....nobody had a clue of holistic view of the situation....all are master of following the checklist ....
i really need lot of help and support from this fourm going ahead ...thank-s a ton for all who has replied....
In my personal opinion ...On top of everything i really need to say that there are so many organaisations like NHS..Child care ...Social care ...CAFCASS..Law centers...NGO organisation ..police and court ....there is no single procedure /protocol clarify and set the thing right in first place between husband /wife and unite the family ....they make issue big (eg:social care) and they have these agencies as place holder to support the issue ....
Families are building blocks of the soceity and if families are running good then there is no place for crime ...drugs...alchohols ..dipresssion etc ....instead of spening millions on each of these cottage industry why cant they spend it first place and have counselling sessions before issuing NMO ....
