Hello I'm recently in process of awaiting family mediator to get back to me to see if my ex will go or not as I need mediator to sign of fm1 form i belive they can sign in c100 anyways .
My son is 4 months old I was at the birth And ex has stopped contact since she's been evicted ,once PR is granted what level of contact would I get looking at his age would it be short 1 to 2hour regular visitation ,contact centre? ,would I be able to take him to my house during the day for 4 hours twice a week and can you add special days to the order like half of Xmas day or Xmas eve, birthdays fathers day etc it would be a dream to design your own child arrangment order is that how it work or do court set it out for you
Hello Danbruno1105,
Is your name on the Birth Certificate? If it is, you already have Parental Responsibility.
If there are no safeguarding issues, there is no reason why you should not have regular contact. If the baby is being breast fed I think this may, for a while, determine the length of time per contact.
You may come to an amicable agreement with your Ex but if not you may wish to pursue access for contact through the court.
I shall leave it for those on here who are more experienced about the court system to outline what the general rule of thumb is. All cases are different and vary on what the individuals circumstances and wishes are.
Hi dan
If mediation fails and you have to apply to the court, as an applicant you would suggest the type of the contact you would like the court to order. A contact centre might be used if the mother won't agree to unsupervised straight away but this is a quite normal progression with young babies.
It would be sensible to suggest a progressive pattern, starting with 1-3 times a week for an hour or two and then gradually increase to unsupervised longer hours. You can indicate to a court what you would like the eventual order to look like (eg contact patterns, holidays, special occasions etc) but that you understand it will take time to progress from the current situation to that proposed.
Hopefully the mother will engage in mediation and you can get some progress without having to attend court.
Good luck, keep us posted and we will do what we can to help.
I'm not currently on the birth certificate so I'm awaiting mediation appoitment and I belive you can kill 2 birds with 1 stone if you apply for child arrangement order and the court will grant PR as part of the order then I can register my name on my own
Is the mother then sent the updated birth certificate or will I always have the one with both parents on and she will have the one with only her on it
