Hi all its been over a month now iv still not spoken to my children the hardest day was fathers day no text no nothing very upsetting iv been mediation and I'm going back to day to pick a letter for the c100 form so I can take her to court problem is I'm skint and on esa I know she is using solicitors and I'm worried she will win and its going to be 6 or more months befor I see my 2 girls who are 3 and 19 months old does anybody have any advice on what I can do iv herd a firm called McKenzie family law but not to sure what to do pls help me. A loving dad.
Hi Peter
Go on to the legal section this is so many sticky topics at the top of the page that are of a great help
I am representing myself while my ex is paying for legal representation and I felt the same as you very worried as she had help that would be at a real disadvantage however this is not the case the judge has been very considerate that I am a LIP and this has gone in my favour as I have said things that her legal side can't and don't get told off as i'm not to know .... since they changed the legal aid process they are so used to people representing themselves and their is a lot of free help to do this,
also just a note the family court process is not seen as winners or losers like in other law , the winners should be the children and therefore the courts should only be interested in what is in the children's best interest,
obviously it will make a difference of why contact was stop but unless it was for the direct safety of the children she will need to answer why it's a long process but after the c100 is filed you may get help with the fee make sure you check, - then it's about 4-6 weeks till a directions hearing even at this hearing the judge can make an interim order for contact - definitely spend time browsing the legal section it's what gave me the strength and confidence to rep myself and I am so glad I did .
Hi Peter, Eric has given you solid advice. There's lots of support and advice to be found on the forums.
If you can't afford the court fee, you need to get a form EX160 from the court or download it from the website.
You can go to the CAB or phone Coram's hepline for free legal advice. Also, most solicitors offer a free 30 minute consultation.
A McKenzie Friend is someone that assists a LIP in court. There are lots of professional ones around but be careful, they are not regulated. They vary in experience, qualifications and price, if you want to look into it then make sure you get a recommendation. There are lots of members on here that have used them, I'm sure someone would help find one in your area.
Yeah man get your FM1 form and pay the fee of £215 if you can otherwise there is help if you're on benefits, once it's done it's done you shouldn't have to fork out anything else.
I will probs go in your favour her being represented and you not as the Courts have a lot of respect for you if you fight on your tod, You know your case better than anyone and them money grabbing so and so's just drag things out to make more ££££££.
I'd be careful about using mckenzie friends to as there's a lot of them out there fleecing dads who are in a pickle and don't know whether they are coming or going the whole industry is unregulated and many of them have no qualifications plus they are not cheap either, do your own research use sites like this and go and see a different solicitor at each stage of the courts like I did and rinse them for the free hour or half hour, they all said carry on doing what I'm doing its actually quite empowering.
Be bold stand your ground and fight like a dog mate 🙂
Thanks bruv ill fight like a dragon dude
Lots of good advice here
As you are receiving benefits you'll be entitled to an exemption from the court fees as 1626 says, form EX160a.
You might like to think about attending a Families Need Fathers meeting in your area, you will get advice and support from people going through the same as you. Here's a link to their webpage where you'll find details of meetings , hopefully you will find one in your area.
