Because I'm self-employed the CSA have made the most incredible mess of the case the mother of my 2 boys started a few years ago. This means we are always both constantly appealing every decision and going to HM Courts Tribunals.
This year she has alleged I am diverting money and hiding income - it seems she can just say this without any grounds - and the Tribunal people are asking to see my personal bank account statements. I have only sent them the evidence regarding my income, this includes the entire bank record of my company, conclusive proof I would say as regards my income, tax statements, the company accounts etc. I have not yet sent my personal bank statements and the deadline has passed.
We exchanged Form E1 last January so I produced ALL account details then including a full listing of everything I possess - it doesn't seem right that my personal bank accounts are gone over by her every year, I only wish to protect my privacy and well, yes, my dignity. Can anybody please advise what powers these people have? Also, where should I be looking for help? All I want is to have some realistic valuation in place, not a different process each year, and would prefer not to have to attend three tribunals a year.
Any help/advice greatly appreciated.
It's been many years since I've been to a tribunal (I instigated it) so it may have changed. I think legally they can ask for whatever proof they need, but even aside that, the problem is that if you refuse to cooperate (by not providing the evidence they ask for) then they are naturally going to assume that you are hiding something, and they are going to rule in favour of your ex.
I would certainly ask the tribunal (assuming that they find nothing to back up her claim) whether there is any course of action you can take against her to stop her wasting your time, and that of the tribunal - they must be getting pretty fed up of it as well. You can also appeal (all the way up to the secretary of state, if I recall correctly) - that can take quite a lot of time, so it could be that you can just prolong the process so that you aren't attending tribunals quite so often, especially if you only respond just within the time limits given.
