[Solved] Taking your child abroad

Hi,

I am asking this question for a mate.

He has a 5 year old daughter who he see's once a week, she sleeps over and he has PR as he was with the mother for a while.

The mother stopped him from taking his child who he sees every week to tenerife this year, he was angry. He said if she stops him next year he will just take her anyways, i advised him that this is not a good idea as without the mothers permission she can push for abduction.

Am i right and what rights does he have?

Your advice to your friend is correct...it would be very unwise to remove his child abroad, it is indeed abduction and he would risk losing alll direct contact with her if he went ahead with it.

To avoid this next year he can use mediation and if that fails, an application for a Specific Issue Order to get the courts permission to take her on holiday, or a much broader Child Arrangements Order which would cover the amount of time he gets to spend with her.
