Hi everyone.. So today as ordered by the Judge at our last hearing on 21st November, my wife was to serve to me, GP evidence report by 4pm today. Nothing!, also she was to answer my scott schedule allegations by 25th October, again. Nothing... We are back in court on 15th January, for a pre trial hearing, then last 3 days of January for the fact finding. What I did receive today from her solicitor was her statement of response to my statement, which again was lies, lies and more lies.. Oh and she's said my 5 and 7year olds don't call me daddy anymore as they are to scared of me.. I've not been allowed to see them in 6 months.. Anyway my question is, now that yet again my wife has failed to serve on time and date, is there a chance the judge could throw this all out at the next hearing??? Thank you for your time and help...

My ex did similar . Didn’t respond or file anything . She played thick . Court didn’t do a thing . They just vacated the fact find as she didn’t make any allegations / submit her Scot schedule etc . I asked my barrister and they said family court don’t really strike things off like they do in crim . So I imagine they may just do away with the fact find and go to a hearing based on verbal submissions . That’s what happened to me

So they cancelled the fact find they was going to be based on evidence , texts , video , reports etc . She refused to submit anything so it was decided by magistrates just talking to us. , no hard evidence just he said she said .. ie verbal only. After neigh on a year got prettt much everything I asked as there was no hard evidence to proove what she said , not that she could anyway .
