Need some advice. Was seceded in Friday non molestation order . This was done what I belive so I don't turn up to collect my children as I have been denied access even though I have a order in place. I'm due in court in Wednesday to give my side as all off what was said was all lies . Not got a bad bine in me or have never been in trouble and don't tend to get into trouble . All I want is to just see my children every other weekend it's just as simple as that . I don't belive I'm asking for much.
What have others had when receiving such this and what is the chance off over turning it . It was given an emergency hearing only in Thursday and granted without any evidence. I've put all my evidence together and it shows what she is demanding it it's the other way around . Why is it so hard to just have what oils a fathers right
Thanx for all your help
Jay
Hi
It's good that you have put your evidence together. You also need to write a statement to go with the evidence to give your side of the story. If you think the application is malicious to obstruct contact, then say so in your statement.
If it's a clear cut case, it's likely the court will throw it out. If it's unclear, the court might ask you to agree to undertakings instead of holding up the order. An undertaking is a promise not to do something.
Good luck
