[Solved] Self Employed

Can any one help me with a question.

I left my work place to start up on my own, A LTD company.

At Present I-draw down a very small amount of wages. I live of saving.

Can I reduced the amount of Money I pay to my Son's mum.

I have thinking of going to the CSA but having used the legal system before not sure if it would be in my intense.

I'm sorry but I know very little about this side of things, I'm sure someone will be along shortly to share their knowledge and experience with you.

You could try using the search tab at the top of the page, to see if you can find previous advice about this subject, perhaps using keywords such as self employed or ltd company.

If CMS assess you it will be based on your salary initially (assumed low) then on assumed variation request from your ex plus any dividends if you pay them to yourself.

The typical assessment for basic £11,850 salary is around £85 per month dependent on how many nights you have your children. If you pay dividends this will show up with HMRC at some point and you will pay for those too.

If this is an honest reflection of your circumstances then the CM payment will remain low, once you pay dividends then it is best to be honest with that (in my opinion) and you will pay extra then.

In my case I have been honest with my salary and the dividends I pay, but my ex thinks I am hiding a pot of gold and has taken me to appeal. In that case I think they can sniff out any covering up you may be doing - although I have not been through mine as yet.

It may be worth having a word with your accountant to see what they say about earnings, and as HRabbit says, if you open a case with CMS, then be completely honest with them. If you think your ex will go to CMS because you are trying to pay less, then in my opinion, it's worth paying the £20 for you to open the case before she does - it implies up front that you are serious about paying maintenance and when the time comes, I believe that you can chose to close the case when your son leaves education, rather than relying on your ex to do it.

Hi There,

I agree with the above, you are better opening the case yourself to get things going, as actd has said speak with your accountant first and get an opinion, in my experience accountants are used to CMS these days so they should have a view, they can also help with the assessment forms that will need to be completed.
