Section 7 Been ordered by the courts allegations previously made in nmo which nmo accepted on no findings by court no admission by father.would the outcome by cafcass push for a fact finding on allegations made in the nmo I have my section 7 interview in 5 weeks.it’s been 7 months no contact with kids next just killing me not seeing them and just feel ex will push for fact finding to delay further

Hi

Yes, generally if there are allegations outstanding which need looking into then CAFCASS would want this exploring first as based on the allegations and the outcome of any fact finding, Cafcass can then determine next steps..

@Daddyup they was explored by police which resulted in nfa and intial that’s what cafcass said in safeguarding letter waiting outcome of police investigation

Hi

CAFCASS will have been waiting to see if the police pursue it on the criminal standard and charge you. Now that the police have NFA, depending on the allegations and what your ex says will determine whether Cafcass will suggest the allegations are looked at to the civil standard or balance of probabilities which is what the family courts use.. Just because the police NFA, does not mean it didn't happen, it just means that the police/CPS cannot prove it to a jury beyond reasonable doubt. It is different in the family courts.

On the other hand if you were charged then cafcass would just go with that..
