Hi.
I'm completing my C100 form and was looking at the concern of risk of harm section.
I am concerned that my ex wife is causing mental anguish for my children. Prior to get stopping access, my children were coming up to me saying things like "Mummy says that I can only stop with you for one day"," Mummy says that you don't give her enough money", " Mummy says that there are good dad's and bad Dad's, and you are a bad dad".
At a recent school assembly, my daughter came up to me to give me a cuddle and tell me what she'd got an award for. When her mother came over , she looked at the ground and wouldn't come near me as if she felt she wasn't allowed.
I am worried that the children are suffering and that the longer they don't see me them the greater the risk to their mental state and relationship with me.
Can anyone advise whether this would be grounds to include risk of harm or even an urgent hearing?
yes on the form, tick the box for risk of harm. if theres an empty box for optional stuff, write down emotional/mental abuse. once cafcass get involved they will take all of this seriously. they told me off once, when kids asked me can they stay the night. i replied: i dunno, ask your mum. they said i should never pass on messages to ex using kids. your ex is brainwashing the kids so thats far worse.
i dont think this is serious enough for urgent hearings. urgent hearings is if there is risk of real physical harm to child, or if their at risk of being abducted or taken out of the country.
... if you want to tell the court about any safeguarding issues/risk of harm to your kids, you can use supplementary form C1a to tell the court about it in more detail. You would then send the two forms in together.
Emotional/psychological abuse can be included and is recognised.

Do I need to put evidence on the C1A form, or as an Appendix to the form, to support the allegations I am making please?
I've been to PSU and they suggest that I have enough evidence to put forward coerssive control concerns and the effect of this on my children on the form.
Or do I leave the detail for a position statement to take to the first hearing?

PSU have good experience with the process and filling in forms for you. but they are not qualified to give legal advice. but yep note down any abuse concerns you have in your position statement.
