Hi my new baby is due at the beginning of January and as I only work 3 days a week I would ideally want equal shared care, how would I go about arranging/applying for this? Also is it correct that maintenance payments wouldn’t be required? I’ve copied a paragraph below from cms and just seek guidance on it also has anybody done this and how do you go about proof so I can spend the money on my child in my care rather than cms??

If the paying parent can prove that they carry out an equal amount of day-to-day care as well as having equal shared care then the Child Maintenance Service regards neither parent to be the paying parent so their child maintenance would be set as nil even if one parent receives Child Benefit or tax credits as the child’s parent. Where there is equal day to day care, and there is no paying parent means that there cannot be a statutory case and the Child maintenance Service would not being able to process the application as there is no identifiable paying parent.
I am a mature dad (46) of two teenage girls who I belive were brought up well by their mum and I who dies suddenly three years ago. I met a nice lady of 3 everything wonderful then moods gradually got worse and more frequent due to her depression, the plan was to buy a house all live together etc etc then after she fell pregnant her eldest who left school at 14 was doing mild drugs then moved his girlfriend in, bought a pit bull got girlfriend pregnant. My partner of two years appears to have no control of him, her other children are under cars of camhs and in the meantime her eldest has been occasionally violent towards his girlfriend and generally ruling the roost to which I wasn’t prepared to move my children to live in that environment. My ex took the hump and although I’ve helped in many ways ie childcare fixing house cars helping with coursework etc when I said the goalposts had moved as I was now expected to find him his girlfriend new baby etc my ex basically washed her hands of me as presumably I wasn’t of any use as had already refused to add her name onto my mortgage which she was very angry about. As a result I feel that with no contact either way in 7 weeks I believe she will use our baby against me and this is not what I am about. Her eldest spend over £100 a week or marajuana most of which he bums off her and I feel that due to this situation I am doing what’s best for our child as opposed to leaving it full time in a potentially violent house with a frequently depressed mother who allows her children to do effectively what they please.including her eldest previously having bitten his mother and also tak n her car without consent
It is not about the money as such it’s about giving my child a start in a more stable environment

Have you spoken to children's services - if her other children are under camhs, then they should certainly have an interest in the welfare of a new baby.
