[Solved] Private arrangement

My ex has 2 kids to me, she recently phoned cms and I received a letter from them, the amount they are asking for would cripple me. I phoned my ex and she said we could come to a private arrangement. My question is this, on the letter she has chosen collect and pay service, but she wants a private arrangement, can this be changed? It alsohas not mentioned a private arrangement as an option.

first of all, LOL@your name. what she has done is weird. did they not ask you first about your income and what you earn? how can they just send a letter with an amount?? or im assuming they just checked your tax records before hand.

far as I know, the only way this becomes a private arrangement is if she tells CMS she wants to go private and for them to close the case.

Unless she closes the case with CMS then they will use their Collection service to take money from you. If you refuse to pay it they will apply and get a deductions from earnings taking it straight off your employer.

the only way you will not use the CMS is by her closing the case with them and you two coming up with a private agreement, however, she is using the CMS to work out what she thinks you should pay and if you offer her less you'll have to be willing to prove to the CMS how much you earn and you will pay out what the CMS decides...no way around the CMS people....they do not care about your financial outgoings as long as they get their money to pay your ex!
don't forget they will charge you to collect the maintenance 20% on top I heard...they'll charge her 5% for the same if I understand it right.

you can work out what you have to pay based on the CMS calculator, if you have more than 52nights per year with the kids then you can reduce the amount you pay but you'll have to have a court order stating the amount of contact for the CMS to accept it....until then they will take your ex's word!
