[Solved] Practice direction 27

Hi All

Got final hearing in March after ex tried to halve my time with the children at the FHDR.

Can anytime give some interpretation of practice direction 27. Just don’t want to fall foul of any procedures as I’m self representing.

Ex is being represented but their whole approach has been to try and discredit me, which I’m confident in batting away.

Hi, I think this refers to the bundle that is submitted which includes details on police back ground checks, social services records, contact visit notes etc. Is your ex accusing you of anything as to why you cannot see them?

Have you been asked to submit one yourself? It might be worth looking in to speaking with solicitors, they may at least give a free consultation to discuss what will happen and they will then obviously offer to represent you if you need them.

Pd27. 3.1
A bundle for the use of the court at the hearing shall be provided by the party in the position of applicant at the hearing (or, if there are cross-applications, by the party whose application was first in time) or, if that person is a litigant in person, by the first listed respondent who is not a litigant in person. Where all the parties are litigants in person none of them shall, unless the court otherwise directs, be obliged to provide a bundle, but any bundle which they choose to lodge must be prepared and lodged so as to comply with this practice direction.

If your ex has a solicitor she’s not LIP and my understanding is she has to do the bundle ( or her solicitor )
If she has a barrister to represent her she could
Still be LIP and the court will direct who produces the bundle . I would suggest it’s rhe ex who has to but you can check with the court. I was technically LIP even though I had a barrister so I had to do the bundle .
If your doing it yourself the court won’t be thst [censored] about sticking to all the directives . Most
Important thing is have the case number on all pages etc

hi,

during my hearings, i hired barrister on each day. but ex had legal aid and fully represented by solicitor. they did bundle and emailed it to me.

Yip , solicitors do the litigation ,barrister not unless hired for that specifically .
