[Solved] please can someone give me advice

Hello all....my name is martin & i need help with CSA...my ex wife absconded with my children over 7 years ago,it took over 14 months to track them down to a location where they live now via solicitor and a lot of solicitors fee's ...these last few years about 2 and a half years the ex has applied for CSA for my young son, i have provided the information and all the paperwork my solicitor gave me to prove my ex wife absconded with my children and she left no letter of forwarding address,or no form of contact,she was also committing adultery. The CSA got back in touch with me to say my paperwork was no relevance to prove that she did abscond with my children,but it did happen,otherwise i owe thousands in arrears. how can i get too prove this ?? its cost me thousands and am on my last legs ...please any help would be appreciated ?? thank you

Hi,

It is disgusting what she has done and i do sympathise but as far as i know the CSA would have expected you to carry on paying no matter what has happened. I have not seen my child for 18 months but i still pay my CSA and have to until she turns 16 weather i see her or not. I may be wrong and if i stand corrected then i have learnt something new.

If you want her on the abduction part then take her to court but dont hope for much because as we all know , mothers can do what they like with no consequences.

Hi there

The CSA does have a complaints/appeals process, if you feel you are being unfairly treated, but if you aren't getting anywhere, you could make an appointment with your MP and discuss it with them...unfortunately you will have to wait until after the general election on the 8th June, I doubt you could get an appointment before then.

Unfortunately, the CSA are not concerned with your ex absconding with your children, their remit is solely with the maintenance to be paid, and that is due whether there is contact or not, and they don't take any regard why contact hasn't taken place, so I'm afraid the bad news is that you are liable for maintenance from the date she opened the case with the CSA.
