I'm a truck driver and work away sometimes so my wages reflect and are verid. I also get paid night out money which is tax free do they take that into consideration on the estimate earnings please also how can you prove how many nights your child stays over this has been going on for over 3 years now and I can't get them to change it my daughter stays at mine as and when she pleases with my partner and we don't have set days. But the csa cms says she's only at mine for 52 days when it's more 50/50 but I have to pay for the privilege of having my daughter any help many thanks
Hi,
CMS like seeing court orders as evidence of 50/50 care. they also claim to accept informal evidence.
I recommend you join this support group for paying parents:
The sad thing is the CMS take no notice when it comes to Court Orders !
I had a 50/50 shared care order and my ex was suppose to hand the kids over alternating weeks and when this happens there is no CMS to pay as you are both parenting equally! She refused to hand them over and breached the court order but despite this the CMS then came after me for the child maintenance even though this breached the high court order
the CMS simply stated - we are not interested what the court say all we are interested in is who the child is actually living with.
