My ex has put in a cms claim and I was in prison at the time. I have contacted cms they said I should have contacted them. I did not even know she had done this. She then contacted them when I came out. So I am paying arrears back from when I was not working and being imprisoned. I have asked cms they said that they can’t change it. It went to a mandatory reconsideration and was upheld and I’m still paying £100 a month arrears. Does any one know if this is correct or is there an other avenue to go down ?
You could go and speak to your MP about it and ask for their help.
I would definitely see you MP and look at the complaints procedure. Does the prison have a record of incoming mail? You actually might be in a fortunate position to be able to prove that they didn't contact you, and so how can you possibly have known to contact them.
Yeh I will contact MP. They said I should have advised them. The ex actual phone to say I was out but because I never contacted them I’m due it.
Only way round it is to ask her to say to cms about the arrears and stop it. No chance of that happening. Also they have my old wage from 2 years ago saying I was making 31g a year even though I’m not now only make 21g and provided proof of being in prison and my wages. Said nothing can be done until the review in November. So I’m paying arrears back on 31g been in prison for 6 months out in new employment and paying over what I should. They said it law
