can a father obtain parental rights if a mother has mental health issues

yes you can as long as you have everdence to back this up

im sure more of the nice people on this site will be along to give more and better advice than me

are you on the birth certificate

how old is the child

Gaining Parental Rights even without mental health issue's is a minefield in itself. I wouldn't think you could gain automatic parental rights just by siting your child's mother has mental health issues.There is a host of criteria you yourself would have to be able to fulfill before you were given PR. As minty 1 say's you would need evidence to back this up and it would not be just on your say so a number of proffesional people would have to become involved.

You would have to apply to the court for PR, being the father obviously is a big help, so any additional evidence you can give would support your case. Can you give some more details such as ages of children, and orders in place, contact etc?
