[Solved] Parental responsibilty without solicitor

Hi

My x got pregnant and said it wasn’t my baby and was someone elses. We parted ways. 6 years later and in feb she came looking for me saying the baby was mine and she had been taking into care. I got in contact with social services and they said as the girl was in their care and i’m not named on the birth certficate they would do a DNA test free of charge which they did and it came back she was my daughter. She is in foster care and they have said they will not let the mother ever have her and have done assessments on me and said that I should apply for a parental responsibility order form and social services will support it. Do i need a solicitor to do this or can i do this myself and which form is it I need as i am just so confused

Hi there

It must have been quite a shock to discover you have a child, six years after the event...and then to find out that she is in the care of the local authority, it must be a confusing and emotional time for you.

Here's a link to to the Parental Responsibility Agreement, you will need to follow the instructions, fill in the form and with the mother, take it to your local family court to get it signed. The court will then register it with the court to make it legal.

The mother will not help me with the parental responsibilty form she is saying if social services wont give her our daughter back then I can’t. So i need to apply through the courts but social services have said they happy to support me but not the mother. Which form do i need than and do i need a solicitor?

Ah ok, then you will need form C1... have you talked to Social Services about putting an application in at the same time, to have your child live with you?

It might also be helpful for you to talk to the Family Rights Group, they're experienced in offering help and advice to families that have children in the care of the local authority. Heres a link to their website

On form C1 you've been asked to submit a supporting FM1 form.

This is to show that mediation has been attempted prior to making a court application. However as there are
ongoing care proceedings for your child, you only need to tick the box to tell them about that, and then sign it at section 3.
