[Solved] Non molestation and occupation order received

Early this morning I was served a non mol and occupation order and it was pretty much unexpected as my daughters mum had lied to the police a month ago and they deemed it NFA no further action, I've stayed away from her since then due to what she may alledge next. She reported I slapped, punched and broke the TV on her head for which she never had a scratch and that is because I never did What she lied about.on that faithful day she got her phone out to record the footage, slapped me so I can hit her back on camera but that's not me. She called the police and they took me away leading to the NFA. She has threatened to make my life a misery due to the bond I share with our daughter. Fast forward to today and the order is here she has tried to fine tune her statement from the one she gave the police. It's been a month now and I haven't seen my baby girl, her grandmother has said she will do whatever to stop me seeing her and this is their latest plot in the movie they are creating. I just want to have contact with my daughter even if it's supervised I don't mind. The charges for getting the no mol order overturned is £1200 which is too steep for me currently as I had to move out and get my own place. Any advice is very much welcome thanks in advance.

Hi Shaun, let me first start by saying everyone here will understand your situation. I came to this forum a few weeks ago losing patience etc, but felt reassured after reading a few responses and receiving one for myself.

£1200 sounds like the kind of price a solicitor would charge? Have you thought of representing yourself? The process isn't too daunting and the only price to pay will be the fee to submit court order forms. Seems like you may have to complete a Contact Arrangements Form (C100 accompanied with some sort of statement). Going thru court may take some time, but atleast you will have time with your baby girl in writing. Apologies I couldn't be anymore help, but if you be patient just a lil more, I'm sure someone will one up my response in no time. All the best to you Shaun. Yass

You really should contest the non mol and you can do this by self representing. You would need to write a statement for the court and speak for yourself at the hearing and point any differences in her statement to the court and police as well.

Plenty of our members self rep, you don't have to pay out thousands to get a successful outcome and the courts are using to dealing with litigants in person.

It might be worth contacting Families Need Fathers for help on this matter and for getting contact reinstated. It will be a lot harder for you to manage contact if you don't contest the non mol.
