Hi
I'm new to this site, but hoped for some helpful information, it's a bit of a long story but here goes... When I first met my children's mother, she told me that she was sexually abused by a family member when she was 14/15. This person has been away from my ex's family for years, but has recently returned and is living in my ex's mums house, where my kids stay regularly. I tried to talk about the issue with my ex, she point blank refused to discuss it, obviously not being happy at the thought my children may be at risk, I contacted social services for advice, they decided to storm ahead and "investigate" the matter and co tacked the kids mum. It's become apparent that the story of her being abused was completely made up (she's known for attention seeking) and she said to social services that I made the story up to "get at" her (why is make up something so specific about a man I've never met is beyond me, but that's the claim she made). Since this has happened, she's stopped me seeing the kids, completely ignores me when I contact her. im currently staying at a relatives house, unemployed having recently come off long term sick, so don't have the £215 for a C100 form, anybody have any input on this?
Thanks
Hi ere
I'm sorry to hear about your problems. You had every right to be concerned for your children because of what she had told you....now you probably don't know what's true or not.
Anyway the good news is that as you are unemployed you will be entitled to Legal Aid for Mediation and an exemption from the £215 court fee.
Mediation is the first step before an application to court can be made, but as said you will be entitled to funding for this. Here's a link to the mediation service
www.nfm.org.uk
If after the mediator has contacted your ex she ignores or refuses their request to attend, or mediation fails, the mediator will sign the C100 form to enable you to make a court application. You will also need form EX160a to claim for an exemption from the court fee.
All the best
Mojo has given you good advice.
Have a good look through the stickies at the top of our Legal Eagle section and please let us know how you get on.
