hi seems I have to go to court again I have no solicitor this time last time ex didn't either she had her sister as a McKenzie friend her sister done a better job for her than my solicitor did first time round
my question is can I stop my ex using her sister as mc Kenzie friend this time as she hightly skill at this knows all the ins /out and willing to lie in court for her sister
Hi Vinny
Can you prove she lied in court previously?
Here's a link to the practice direction on McKenzie Friends, you could object on point 6, as being her sister she has a personal interest in the case and if you can show that there's animosity between you and her sister that might help.
Was her sister allowed to speak in the hearing? Mojo is correct that you can argue on point 6 but it's highly unusual for MF's to be granted 'rights of audience' unless there are exceptional circumstances or the judge believes it will assist the court during the proceedings. I know sometimes a judge allows family members in as MF's unless the other side objects but it's very rare.
