[Solved] Maintenance Payment

I have recently split with my partner. We have a 2 year daughter and at the present time I have her 4 nights a week and my partner has her 3 nights a week. My partner has brought up about maintenance payment. Does anyone know if I need to pay as I am currently paying child care and she is getting all the benefits?

In theory you shouldn't need to pay your ex as you have your daughter more nights than she does, but as your ex is claiming the child benifits then she could open a case with CMS and they would look into what should be paid, if there isn't an order in place to back up the time your daughter stays with you you may have issues proving that you have her with you for the extra night a week.

if you have her more than 3 nights a week then its you that is entitled to the benefits and tax credits
