I was paying my ex missus £65.00 a week for two kids and giving them £25.00 a week pocket money every week.
I was also buying their clothes, school uniforms and any days out.
In 2017 I took them on a week long holiday to Malaysia for their birthday treat. (Both born 1 day apart)!
In May 2019 my ex contacted me to say she wants money to take the kids to see their grandmother abroad.
I refused saying I'm slightly short of money at the moment (current missus expecting a new baby).
She decided to contact the CMA who have hit me with a bill of £117.00 a week!
Moreover, my ex told the CMA I never see the kids. Hence the high bill. When I disputed this to the CMA, they said they will contact her and if she says its I'm wrong, then they will take her word for it.
I'm now being forced to work excessive overtime at work to keep up with the payments. Chances are, I'm going to beat the gross figure quoted to me by CMA. My payments will increase again which it may get to a point where I may have to leave the job.
Question I would like to ask is if I do leave the job and go partime somewhere else, will they still pursue me for the original payment of £117.00 a week?
Someone help please.
The cms wil review the numbers once a year, or, if you report that your income dropped by 25% or more. If you start working part time, presumably your income will drop by more than 25%. I believe they would apply the new calculation from the date you report it.
If in doubt give them a call and ask.
hi,
your ex or CMS can not force you to work to keep up with payments. your making things more difficult for yourself in future by doing over-time. be careful with CMS, if you tell them your out of work and lets say your out of work for 6 months, when you start working again, CMS will make you make 6 months of back-dated payments.
whatever your income is now, contact CMS and ask them to assess it and calculate payments. in future if you go part-time, let CMS know and give them income details. if kids stay overnight with you, then basically CMS will only believe you if you have a court order as proof, or if your ex tells them that they stay overnight with you.
also, are you paying into a pension? do you spend lot of money on fuel to pick up/drop kids? you can claim discounts for this.
