Hi all, this is my first post. I pay CSA via attachment of earnings order for my 15 year old daughter. Due to problems at home she has expressed the wish to leave home and live with her sister who is 21, once she turns 16. Can my eldest daughter claim CSA for her sister and if so what proof would the CSA require. Many thanks Robin. Slough, Berks
Hi Robin
I'm not 100% sure but I would think so. Perhaps you could check with Child Maintenance Options.
As long as your daughter is still is still in full time education, child benefit, working families tax credits and CSA should continue and I would think that whoever the child is living with would be entitled to claim...just my opinion though.
The fact that your sister was claiming child benefit would be enough proof for the CSA I think.
I think you have it correct there NJ, from what I recall. It's worth checking with CMO because presumably she could claim maintenance from both you and your ex, (though you can agree maintenance without going to the CMS) and I'm not sure how that's split.
Many thanks for the advice
