I have tried finding answer to couple of simple questions.
1. If my ex wife is working full time, why her income i not taken into account when child maintenance is calculated?
2. Also do i have ot pay for child minder fees, if kids are going to nursery/child minders while my ex is working?
1. Both parents have to support their kids. If the kids live with her most of the time then it is automatically assumed she is maintaining them.
2. No you don't have to pay for nursery or child minders unless you have agreed to do so. The maintenance you give her covers this. Likewise you don't have to pay for school dinners at all and extra-curricular activities in her time as the maintenance you give covers this. If you want to minimise her meddling with your life on the days you have contact sort out your own childcare if you need it, buy your own clothes and shoes for your kids to wear from supermarkets and don't mention these things to her if she is hostile.
Law is what it is ... if she’s earning and you think what you’re paying is unfair and can’t agree yourselves then you’ll have to go to court . I don’t think anyone here has an issue paying child support . You can argue over spousal in court
yep. i asked same question to CMS. i said if shes on benefits or even working, does that have any bearing on how much maintenance i pay? they said no, doesn't make any difference to what i have to pay.
I think the mindset you have to take is that the money is for the children, not for your ex. If you think your contributions have been calculated properly based on your earnings, then keep focused on that.
My son's mother was on full benefits until he started primary school. She's been working for the last few years and I have no idea how much she's earning - I'm really not interested.
You don't have to pay for 'extras' your ex might want unless you choose to. Your ex has no right to expect/demand you contribute towards childminding costs while she is working - she can ask, but will have to live with a 'no, sorry' as the final words, if that's the answer.
1) your ex could earn 2 thousand pounds a week and you would still have to pay child maintenance based on what you earn
2) No, you aren't responsible for any child minding fees unless you use a childminder whilst your child is in your care
