[Solved] House on mortage

We both have a house on mortage and as per the non molestation order she gets to stay there while I stay away in a room as big as a box.
I want to sell the house as I don't benefit at all. I now live from pay check to pay check, with no savings as I pay for the mortage, the room I live in and send her an additional half of the bills.

Should I ask for the house to be sold or wait for the next hearing?

unless your ex will agree to selling the house, I think you'll have to wait until the next hearing at least - if you try to do anything beforehand, I think it could wind up being worse for you.

Hi There,

I agree, unless she agrees to sell then you would need to wait for now, and as you have a non mol order, it would be difficult to discuss at this point.

You don't need to be paying half the household bills though, at this point you would only be required to pay half the mortgage, as you are no longer living there the bills would no longer be down to you.

What about council tax?

And I pay the full mortage payment where in court she promised to pay half, none received...

I have also requested her through a third party to inform me about child care bills as I wish to pay half but i have not received any answer yet.
And so on with food for the child... No answer

Hi There,

you wouldn't be liable for council tax either as you are no longer living there.

The mortgage you are liable for as you have a signed contract with the mortgage company. If you were to only pay your half and she defaulted on her half they would come to you for the shortfall anyway so if she isn't covering her half as she agreed to then you paying it already stops it going into arrears and you being chased for it,

I'm not up to speed with your case but you would have to deal with financial issues in a separate application.
