[Solved] Holidays count towards child maintenance

So, I'm being told that my ex is going to CSA despite me overpaying! I've just taken my boys for two weeks holiday and need to know if this counts within the CSA nights spent with parent? Can you help.

Any night you have your child counts towards to cms calculation. Just be awake though that if you and your ex partner disagree about nights spent with you then the CMS always automatically side with the mother, it happened to me and it stinks to be honest.
If your over paying now then it could go in your favour of she took you to the cms,

Yep, if she's going to the CMS, I would stick strictly to their calculation. If you feel that you should pay more, then don't but instead put it into a savings account for your sons for when they are older.

Thanks Gents for your assistance. I've not had anything from CSA just the suggestion that they will be in touch and been told by the Mother of our children that Holidays do not count in calculations. I'll get to the bottom of it.

If you don't have a case at the moment, then it will be the CMS. To be honest, I would open the case with them if I were you - costs you £20 to do so - but then you have the control of when the case is closed, in case she lies later on about education attendance etc.
