[Solved] Holiday abroad

Hi can anyone help, i have booked a holiday abroad for myself my partner and my 8 year old son, my ex wife and eldest sons are doing everything they can to stop him going, can they do this? Do i have rights? Any help is greatly appreciated

I beleive (and im no legal counsel) that you need the written consent of both parents if someone's name is different on the passports. We are trying to stop the father of our daughters taking them abroad with his dad who has property in Jordan, and we fear he may try to take them there.

From my understandings..
I think that you need the consent of all persons with parental responsibility.

If there is a court order in place - on the order it will say residential parent can take them away for up to 28 days (as long as it does not interefere with the time spent with the other parent) but the non residential will need consent from all persons with parental responsibility.

My partner is trying to take his daughter abroad and does not have consent from the mother so is going through court to have it as a part on the order.

If you don't have a court order, you will need to apply for one, as it's only a court order that can allow you to take your child abroad if the mother won't let you.

If the holiday is imminent, you can make an emergency application. If it's a couple of months or more away, you would have to make a regular application and attempt mediation first.
