[Solved] Higher education

Please help I'm a bit confused!!!..

My 18 year old son has just finished his Btec level 3 in engineering but failed to get the results he needed to go straight onto a degree course. Our local university has offered him a place at their college (which is on the university campus) on a 4 year course with the first year being a foundation level. The expectation will be to progress onto his relevant engineering degree after this year.
My ex wife still intends to claim child benefit for him this will obviously mean I will have to keep paying child maintenance. I have checked on the GOV.uk website regarding foundation courses but I am struggling to find out whether she is able to claim child benefit....anyone out there who could advise me please?

Yes I spotted that on the Government website but I'm not too sure what level a foundation level of a degree is? My ex seems to think its the same as a level 3 course but I've also been told its a level 4 course.

Level 3 I continue to pay maintenance but level 4 it stops.

Under the child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid.

Education must be full-time (more than an average of 12 hours’ supervised study a week during term time) and ‘non-advanced’. This includes:

GCSEs
A levels
iGCSEs
Pre-U
International Baccalaureate
NVQ/SVQ level 1, 2 or 3
BTEC National Diploma, National Certificate and First Diploma
SCE higher grade or similar

It does not include ‘advanced’ education, eg:

A degree
Diploma of Higher Education
NVQ level 4 or above
BTEC Higher National Certificate (HNC)
Teacher training
