Hi,
I am anxious regarding the wording of a letter that the courts will be passing to my ex prior to our variation hearing next week. I need to drop it off at court in the morning for them to forward. I would be extremely grateful if someone could please read through this for me and feedback their thoughts. As I say, I'm very nervous about how to word things:
In relation to our hearing on the 17/09/14, please find attached my proposal to vary/amend the current contact order we have in place.
I would firstly like to add that contact with since September 2013 has been simply wonderful and we both thrive from being in each other’s company. It continues to bring me a great deal of honour to see our daughter excelling and growing into the clever, considerate and beautiful child she was always destined to be.
The current order states contact is on a week 1, week 2 basis. Week 1 being Wednesday evening to Friday morning, and week 2 being Saturday afternoon until Monday morning. This gives * 4 nights out of 14 with me. As I have mentioned on various occasions with solicitors and attempted mediation my wish is to spend more time with our daughter, something which she wishes for too. My proposal is to alter the current agreement so that I collect * at 13:30 on Saturdays and then dropping off at school on the Friday morning. This giving us 6 nights out of 14 together. I certainly do not feel this request is in anyway excessive, but in fact is more beneficial to our daughter. The main reason I give for this is stability and continuity. The current arrangement see’s 4 nights contact being split in half by a return home for one night in between. At times this can become confusing for our daughter, and I feel a fixed block of 6 night’s contact every other week would bring more stability to the arrangement and provide her with the belief that both parents are fully involved in her life, something she has been used to throughout her life prior to the separation.
My proposed dates also include the 50/50 split of school holidays and the sharing of special days (as per the current order). The only other thing I wish to incorporate is the sharing of our daughter’s special events at school: for example sports days, plays, award evening, all of which unfortunately I missed out on this and last year. I am also very conscious of our daughters increased improvement at gymnastics that she attends every Saturday, and this new proposal ensures that there would be no interference with that outside of school holidays.
After seeking advice regarding changing the collection location to High School (your place of work on Saturdays) I am still extremely reluctant to collect from this location that I have been told I need to collect from in case of any misinterpretation of my current injunction and the possible implications for myself. This being the case, whatever the given assurances are. This aside I do not currently drive and it is a 1 mile walk to the closest bus stop from* High School, with the next available bus being 14:22. I do not feel this to be fair on our daughter to have to walk such a distance and then wait for 40 minutes or so for a bus. Unfortunately due to current commitments there are no family members who can facilitate the collection of *.
I have also spoken to **** contact centre, who are more than happy to facilitate Saturday drop off/collections at 13:30. I shall bring the referral form to court with me on the 17/09/14.
I sincerely wish this can be resolved quickly and amicably and in the best interest of our daughter. As I have mentioned above, I do not feel my request to be excessive whatsoever and do sincerely believe the split of contact I have proposed to be in fact more stable, beneficial, and will provide our daughter with a greater sense of parental input from both sides which I believe to be detrimental to her continued growth as a young lady.
Hi There,
As I don't know what has happened leading up to this letter (I have had a quick read through past posts) it's hard to say if what you are asking for is acceptable, but what is written is very clear and concise with backed up reasons for what you are asking for so I would say it looks good from that respect.
