Good Morning.
I currently pay Child Maintenance for my son who finishes college on the 24th July and is due to go to University from September 2018 .
He is currently 18
Two questions
I have a longstanding court order showing I will cease paying when he reaches 19 or Full Time Education ?
Can I enforce the court order even though he could be at University !
Secondly how can I establish that the course he is taking warrants paying Child Maintenance until he is 20!!
What is the criteria ? How days or hours ?
Any advice would be grateful ?

Sorry, I've just realised, you are paying under a court order, not CMS - in theory you could be paying while in university on that basis. However, if you open a case under CMS, if the court order is over 12 months old (which sounds the case), then CMS takes precedence and goes up to age 20 - it depends on whether the mother then gives any information to the CMS about what the course level is.

Do i apply to the CSM with the correct paperwork to stop the maintenance?

I would give the CMS a call first (they may direct your to CMO first, not sure on the process these days), but hopefully a phone call will put you in the right direction.
