[Solved] final statements

Hi,
Is it a legal requirement for the applicant and respondent to exchange statements in preparation for a final hearing on a shared access case?

If so, does the exchange need to be carried out prior to issuing the statements to court?

Hi there

If there is an interim order in place that states both applicant and respondent must exchange statements prior to a final hearing then it is a legal requirement. In this circumstance the date and time for exchange of statements is usually indicated on the order and both parties would file their statement with the court at the same time.

If the judge hasn't asked for statements then there isn't a requirement to provide one. If either party felt it necessary to file a statement even though it hadn't been ordered, they would need to write to the court beforehand and ask for permission to file.
