Hi,
I am at court soon for a final hearing wit regards to Child Arrangement Order , and need to prepare a statement, does anyone know what the statement needs to contain please ?
Regards
Jonathan
Hi, and welcome.
It’s difficult to answer that question without some of the case detail, but in general terms and making some assumptions, I’d guess you have been to a directions hearing and the order that came out of that should have some indication of what the statement should be about ?
What are you asking of the court ? Are you asking for the child to live with you ? To see the child a certain amount of time ? Have there been allegations made that you are having to respond to ? Have you got any allegations you’d like to raise ?
In general, I’d make sure to explain:
Why you are in court
What you want the court to do
Why/How the court issuing an order as per your request is of benefit for the child
Any concerns you have about the other party ( but only if they are genuine concerns that can be proven, avoid getting tangled in a badmouthing contest, it will hurt you ).
Do let us know if we can be of more specific help.
Thank you that information is very helpful.
On last court hearing we were asked to agree on contact going forward. He currently lives with me in his family home after his mam left to be with her new partner, 4 nights a week with me, all day sat and most of sunday. Then he see's his mam 3 nights a week and a Sunday afternoon. I take him to school on a Monday and get his back on Thursday tea time after work.
I am going to seek a residency order if possible, his mam is currently required to take a detailed liver function test on which i am awaiting results, but as usual she is dragging her heels on this.
Going forward I am going to suggest 2 nights during the week plus one day and evening on a weekend so he can spend time with his mam at his grandparents house, plus 1 week during summer holidays. This is is because she is accusing me of not letting her have any quality time with him.
Are you receiving child benefit and tax credits for your son? As you have him 4 nights you are entitled to claim for them. Is the mother asking for more than the three nights a week that she currently gets? Is she wanting him t live with her?
If the statement was ordered, does the court specify what type of statement/how many pages and does the mother have to do one at the same time, or after she has received yours?
When is it due to be filed with the court?
If you are going to seek residency, what have you actually applied for?
If she is already having him three nights a week, you are proposing a reduction in the time she spends with him? I'm not sure how that will go down with the court to be honest.
Its no really a reduction in time, its a night on a weekend instead of during the week so she still has him 3 nights and i have him 4 nights.
She has nowhere to live at moment, staying with her parents 3 nights and her new boyfriend 4 nights.
I will be seeking residency for my son at court. It is his mam who is "taking me to court" for more access on weekends.
At the moment I am awaiting Liver Function Test results from her solicitor to show if she has damaged her liver by her excessive drinking.
At solicitor tomorrow so will discuss statement i guess, it is costing an absolute fortune as i require a barrister at final hearing.
She was still claiming child benefit and refused to let me have it for our son, so i have put in a child benefit rival claim. Once this is settled i can then apply for tax credits and maintenance from his mam.
At the moment she has stopped paying the mortgage and all bills for the family home simply stating "you can afford it on your wage !!!", and "i need all my money for my solicitor"
It is due to be filed at court by the 5th of January, still awaiting a copy of the last court order that we went to court for on 8th December to see what i need to put in my statement
