Hi. Having problems with my ex and now she is wanting me to do all the driving
I split from my ex gf about 4 years ago and we have a 5 year old boy. I moved out (about 20 min's away) which picking up and dropping off was not a problem.
She then met a guy about 2 years ago and moved away with my boy. It's about 80 miles away and takes about 2 hours to drive there.
At first she or her partner was driving or catching the train the meet me about half way but no she and her partner has split up and now she now longer has a car and now she is refusing to catch a train to meet me halfway
I have him once a fort night. He comes to mine on the Friday then back to his mum's on a Sunday. She wants me to pick him up from school even tho I don't finish till 5 and could be anywhere upto 3 hours away from his school as my job involves in a lot of driving. Then do the 2 hour journey back to hers.
I find this very unfair on a 5 year old who would be getting mine most probably 9ish on the Friday.
I have asked her why she can't take athe train and all she said it that that's not an option and that's that??
I've even offered to pay for the train fai but still no.
Any help on this situation would be most appreciated
You can try mediation to see if she will help out at all - www.nfm.org.uk - but if that doesn't work, then you are looking at going to court for a child arrangement order. However, there is no guarantee that a court will rule in your favour with regards to travel, so it is best to try to come to some agreement if you can.
Our next step is mediation but we had already gone down that route before and she never stuck to it. To be honest she only does what's best for her not our son.
I always thought it was up to the person who moved away to make the driving arrangements?
I have tried every option but she won't have it
The court will look at it from the point of the child, but they will also take into account the fact that she doesn't have a car, and also unfortunately, I suspect they also take into account what is enforceable - in other words, what can be done if she breaches the conditions. I would say that expecting you to do the Friday pickup is unreasonable, so you may get somewhere.
