Thanks Bill!
Has anyone been through a consent order or nominal maintenance variation?

Nope because I rushed to the CMS. My ex tried that [censored] on me and my solicitor told her to remove it. Then she started her [censored] on the solicitor.
As soon as your year is up run to the CMS.
Yes but CMS won't remove the nominal maintenance part will it?

hi, as other person mentions, soon as 12 month period is over, you sign yourself up to CMS, and what amount they decide will over-ride your current arrangement with regards to child maintenance payments.
Thanks Bill,
I hope I'm not being stupid here...but isn't that different to the nominal maintenance? Doesn't the nominal maintenance remain outside of CMS? I think that's what the ex is referring to.
hi,
im not very clued up on this issue. is the nominal thing spousal maintenance? if its just child maintenance, then registering with CMS will take precedence. try negotiate with ex. otherwise she can make a court application again if she wants.
Hi Bill,
That's my concern...nominal maintenance is where you pay £1 a year (but don't actually), which allows your ex to come back to you for money at a future point if there is a genuine need.
That would be her applying to vary the consent order/nominal maintenance to make it substantive. I should never have agreed to it but 'apparently' it's the norm these days and I couldn't afford the FH that was around the corner.
