If my ex wife emigrates to New Zealand to be with her new partner and takes the boys , who are 16 and 18 can she still claim maintenance ?
She received a huge lottery sized pay off and her new partner has a house .. needless to say I got hammered by the two of them but my boys have stuck with me 50/50 but she is buying them with the NZ lifestyle .
I think she is still entitled to claim child maintenance through CMS as long as your boys are in full time education up to age 20 - but I'm not sure what classes as full time education if they move to New Zealand - I'd give CMS a call and see what proof they'd need that they are in full time education over there - it may be that the CMS can't check this and you'd then not be liable because of this, but I'm really not sure about this.
