Hi Dads,
Need your advice please. 2 years ago I took the mother of if my child to court for full custody- which I won and my son has been living with me ever since. The mother was paying child maintenance.
My ex re-married and became pregnant and she stopped paying child maintenance when she went on maternity leave. My ex is a partner in an accountancy firm earning £70k plus a year, however confirmed to CSA that as she is self employed and not earning whilst she is on maternity leave then she will not be paying anymore child maintenance - even though she receives annual dividends from the firm that she is a partner and has a house that she rents out and receives an income from plus plenty if savings in her bank account
The court order states that she is meant to have her son every other weekend and take him out for dinner every other Monday - which she does not do
I am a single parent working a zero hours contract and finding it extremely difficult to make ends meet and having a hard time in accepting that she does nothing to help support her child
I would like to get a family solicitor involved as I know that she is purposely deceiving the CSA but unfortunately do not have the funds to do so. I also want to take her back to court and strip her of her parental responsibility once and for all but again this costs money for which I simply do not have at the moment
Anybody out there that can provide some much needed advice
Thank you
Hi
Sorry to hear about your situation.....
Unfortunately, I would forget about stripping her of PR, it very rarely happens and even then, only in exceptional circumstances.....
With regard to maintenance - it's probably worth having a free 30 minute consultation with a lawyer to assess the worth in making a financial application to the court. If they think it's worthwhile you can do this yourself and probably would be exempt from the court fee. She would then have to list all her assets and income to the court.
Thank you for this. I will do some research re good family so,ictors in my area and make an appointment
Re having to produce all of her assets - would she not have been required to thus thus by the CSA so that they can ascertain how much maintenance she should have to pay?
Thanks again for your assistance
Nope, they just base it on income.
Financial applications to the court are different. Speak to a solicitor who can look at your individual circumstances and previous settlements to see if there's anything you can do.
