Hi, apologies if this question has been asked already (i couldn't find it) but has any of the Dads here ever had experience in getting full custody of their kids. We are separating and my wife works in London but i work from home and have for the past 3 years been the parent who gets them up, feeds them, takes them to school, picks them up, feeds them, puts them to bed , ...
I dont think my kids would prefer to go to breakfast or after school club or want things to change how things are done, but is it possible to get custody?
thanks all for any help
Hi there
It is possible yes, but it would be a lot easier if your wife agrees to it. Have you discussed arrangements for the children?
If you can't agree, and she is threatening to take them, you can apply for an urgent Prohibited Steps Order to prevent their removal and a Child Arrangements Order to say that they live with you.
It's likely the court would agree to putting a temporary order in place, but they will want to set further hearings to investigate the situation in more detail, to help them decide what will be best for the children in the long term.
All the best
It is possible - I did it a number of years ago. However I agree with mojo, that if you can come to an agreement, then that is by far the best solution. As a matter of interest, what is you wife proposing should happen with regards to your children? If the children reside with her, you will be liable for child maintenance, but that's based on your income, and if she needs to put them in school clubs, then you don't pay extra for this - in fact, if it looks as though they are going to reside with her, I would open a case with CMS before the financial stuff gets to court - a court won't override an existing CMS order.
