My daughter is 17 and has her own child. She is in full time education living with her mum. However due to having a child of her own and claiming universal credit and child benefit for the child should I still be paying maintenance?

Thanks

hi,

yes from experience you would have to continue paying maintenance as long as she remains in full time, non-advanced education. i asked CMS is the amount i pay affected if ex is claiming benefits or working. they said no i still have to pay no matter if shes working or on benefits.

Child maintenance payments usually stop when the child reaches 16 (or 20 if they're in full-time education up to A-level or equivalent). Child maintenance can also stop if, for example: the child stops being eligible for Child Benefit.

My daughter is also claiming benefits not just her mother and carers allowance which are classes as income
