Hi can anyone help. I got divorced 8yrs ago giving my wife our marital home and it's contents. This was done for the girls and we have joint custody. Some 6yrs later she is remarried and has two more children and has now come at me for CSA payments. Can she do this given the previous agreement even though we had nothing in writing. Feel like I'm been had to pay for her to do nothing?
Hi There,
Unfortunately she can, CSA/CMS systems won't take into account any financial agreement you had made prior to her contacting them, they will simply act on her behalf to set up a payment system and award a percentage of your wage, I'm not even sure if you had have gotten the agreement in writting whether that would have changed anything as from memory they don't accept that sort of thing unless maybe it was court ordered.
Sorry to be the bearer of bad news.
