I'm currently going to court with my x wife about access to seeing our 8 year old son as we cant agree days due to her insisting that I have him while I'm working 12 hour shift nights and days and have no child cover, She has another son to another dad with a court order for access already in place and have just married another fella with 2 children with another court order attached. that's 2 court orders before I get sorted...
The question is does anybody of you kind soles know how that will affect me gaining access to seeing my son and will it factor into a judges judgment when he makes a decision??
kind regard's in advance,
Hi there
The court orders for the other children will have no bearing on your own child's case. If the other children aren't named on the application (which they won't be) the court won't usually concern themselves, although any CAFCASS reports may reference the other children, particularly the half sibling.
You cannot be forced to have your son, If you are working it's totally acceptable for you to ask for a schedule of contact that takes account of your shifts. It would be helpful if you can provide an advanced shift pattern so that a workable schedule can be agreed.
All the best
