Right today I've just got back my court order back from the solicitors, firstly the courts have ordered a dna test to be carried out by the mother of my baby and my daughter, by no later than 3rd november, and mine to follow no later than the 7th november, IT'S THE 9TH of november today???
Second : my solicitor has asked the court for the respondent to foot the bill for the last hearing, because she never turned up, no excuse and no request for a adjournment. But no such order has been made, surely there must be a mistake somewhere along the lines, either by my solicitor or the court,
Should I contest this?? Also no warning or nothing to the respondents??? Confused
Either you or your solicitor needs to contact the court and explain that the date for the DNA has been missed as you have only just received the court paperwork concerning this. I would then get it done ASAP.
As far as costs go, your solicitor can ask, but it's extremely rare for them to be awarded, your solicitor should have explained that to you, it's always worth asking, but without expectation of getting a result on it.
The court may have written to her to advise her not to ignore the next hearing, but it's better if you just concentrate on your own case and not get too wound up about what the other side may or may not be doing.
