[Solved] CMS mistakes

I’m being assessed for the second time and just wondering if anyone else is having similar problems
Current regulations state they assess your gross salary minus your pension. However they get their figures from
HMRC who do not have your pension details and both times I have had to deal with staff who do not have any understanding of the process are rude, intimidating and aggressive.
Each time I have won and had my pension accounted for as my employer provided the information but it was a fight which I had to involve my MP both times
As for their calculations I have yet to receive a communication where the maths throughout is accurate
So I’d like to hear from others who have had this issue but also to say check they have accounted for your pension and check, check and check again all of their maths

HMRC should surely know about your pension - if you are paying it yourself and not having it deducted from your salary, then you or your pension company should be claiming tax relief on this, which is how HMRC should know about it. It might be worth questioning HMRC why they haven't given CMS this figure.

I am currently go through issues similar.

my case was transferred from CSA to CMS - i was unemployed fro large part of 11/15 through to 10/16. Upon employment CMS took my case over and was given new access details to this self service login which is absolutley useless never works.

They claimed mid way through last year they have recieved arrear notifications from CSA therefore i njeed to make up payments. I challenged them on this that there was letters as proof stating i was unemployed from periods therefore could not be arrears, also i claimed JSA so should be available from HMRC. Each time they ignore and exclude this fact.

Tried calling CSA regarding this - they refused to talk with me, halfway through security!

So back to speaking with CMS about what my calculation is based on because i have been paying as if my son stays 1 night a week, when he stays 3/4 nights every other week. They was aggressive and refused and said they need to check with the other party. Who by the way lied even though i have a diary and text to confirm when i pick up and drop off. Also i challenged about pension they said they do not take that into consideration. is there a way to prove her lies. The court order gives me one less day but encouraged us to communicate which works in her favour because she agrees with me, then when it come to CMS she lies. When she feels like punishing me for whatever reasons i get calls from them saying i have missed payments but of course are untrue.

I could not believe how ridiculous the guy on the phone was - i could tell he was being upmost professional by completely lying too.

I find this service worse than the CSA who were reasonable and we worked out the calcs and payments. I want to get more familiar with this but everything goes through portal which you can never log into!!! Very frustrating.

i want to go for shared care 50/50

I think you can ask to speak to someone senior, they usually have a better grasp of the actually rules. If you make an official complaint they should also escalate it up to someone that understands the system more... you can also take it to your MP if you feel you're not getting anywhere. Perhaps if you let them know that all conversations are automatically recorded, they might be more careful about giving you wrong info or being rude or aggressive.

i have successfully managed to now after 3 weeks of trying to now access the self service portal.

The CMS are requesting arrears from an old case handled by CSA, but i have now uploaded letter proving that i was unemployed from the period i believe they are looking for me to catch up on arrears,

I have also challenged the calculation because mine has not been amended considering i have my sone for 3 nights every other weekend and shared holidays whoch accounts for shared care. I spoke with them recently and they said that because my ex denies this they cant do anything about it.

On the portal i have now challenged this stating that i have proof of texts, photos and recorded journal/diary to prove that i have my son and that they should be taken into account. I will see what response i get back. Annoying thing is they dont allow you to view the ' sent' messages, so you often think they have not been sent.

If this fails then i will write to my MP.

MP's aren't always quick to act (they are very busy if they are good) so I would say it might be worth writing now - worst case, you can write later on to tell him/her that the case has been resolved.
