[Solved] CMS is failing the honest and true fathers

I am writing here today with a 10ft length of rope that I have named the rope of injustice, it is placed in my flat in the corner of my room we're as everyday I wonder if today is that day that it will end my exsistsnce on this planet, what is alarmingly insane to me is how I have named this piece of rope that sits there all to dormant and yet this will be the final chapter in my life if my mental state of mind deterates any more, How did I get to this place in time you might ask and what caused it, its very simple, and yet very complicated due to the absolute disgusting and despicable way the child maintenance service has dealt with my case and more importantly my payment plan.

They have been taking money and creating debt on earnings that I earned in 2014, we are now entering 2017 shortly but after legendary calls ( starting from may 2014 to date 452 calls ) and speaking to some genuine caring people who work for the CMS and not so genuine, may I remind you calls are recorded for training and for evidence if needed which is fine by me as my calls are very much simple in the fact that I would like to know why my payment plan I should based on 2014 earnings which that year I earn't £39,500 which to some is a fantastic wage and to others is not, may I remind I worked 70 hours a week to get that wage and believe me I barely slept during that year with the amount of work hours I did , I lost my job in may 2014 and since then I have struggled ever since as the payments that followed after loosing my job crippled me. In 2015 I earnt £8,854 and in 2016 I earnt £14,142 and this is going on the up to date records the HMRC have as I have spoken to them just as much as the CMS, yet the computer system they use at the CMS which I have been told on several occasions uses the HMRC up to date information was not visible and I quote " no information found for years 2015 and 2016 . Now for all you out there who do not know the Data Protection Act of 1998 and the eight principles it carries principle 4 clearly states and I quote " Personal Data shall be accurate And, where necessary, kept up to date. "
This is clearly a breach in the law which constitutes that the HMRC and the CMS should have up to date information which the HMRC have informed me they have? So why haven't the CMS got their records up to date, calls are recorded remember and this has been brought to their attention over the last 14 month countless times and yet has not been acted on over the last five months I started a job and got £832.00 pound taken straight from my wages per month which after tax And insurance left me £746.00 to live on my one bedroom flat rent is £450.00 I was blown away at this and what followed just sent me over the edge the nice lady at the CMS said I had occurred a £8'132.00 debt based on their non up to date records and what I earnt in 2014, I then found my new friend the one I named the rope of injustice as clearly sat on the Old bailey in London is the scales of justice, how ironic that they share one common noun .. justice ...yet are worlds apart. My local mp is involved in this and the wheels turn very very slowly, I lost my job recently due to the extortionate court orders that they try to justify as arrears due to yet again 2014 tax earnings, oh my gosh ground hog day no further forward and no one cares?
I lost my job as could not support my self not economically viable, keeping my one bedroom flat has become an impossible task and my mental state of mind is darker than any cave as I feel lost and lonely. I am now in receipt of JSA and at present not economically viable to employ as cannot support myself as soon as I get a job I get £832.00 taken out of my wages regardless of what I earn? Yet they tell me at the CMS that they will look into this ...Erm no you don't clearly

I have maintained from day 1 that I have no problem paying for my daughter with child support and say this on every call I have ever made as this is all about children and supporting your kids, but this CMS system is failing the honest and hard working fathers of today who work so hard and have no guideance or help by the CMS at all, Tom McCormack Director of the child maintence Group, Department for work and pensions and Caroline Nokes, Parlimentary under-secretary of state and welfare delivery, department of work and pensions, have recently sat with the work and pension system committee on December the 7th giving oral evidence : child maintenance service HC 587 and stated on sereval occasions that they work with HMRC and use their information to make the CMS descisions . Caroline nokes clearly states on Several occasions that they use HMRC for accurate information ? Research will be needed in order to do this.

Thank you for taking the time to read my thoughts and the injustice I am recieving to date, it all starts with my exwife who lives in a four bedroom house with a partner who supposedly lives there 2 nights a week ( big cough) who has her wage, partners wage, family tax credits and was getting £832.00 who has 3 holidays a year and uses the CMS as a career to keep her lavish lifestyle while I am sorry to say this, looking at the rope of injustice and feeling it's my only way to end this misery.

Hi Sean

All I can say - is hang on in there. It does get better. There is help and support out there, this place included.

Many of us here have been through the same (or similar) process that you are going through - exasperating as it is.
It sounds like you are doing the necessary things already (involving MP, etc) - and obviously keep trying to get your information with HMRC updated.

If no one else is around for you to reach out too this evening/morning, the Samaritans are just a phone call away. Sometimes having someone just listen is helpful.
The HMRC and CMS are important - but not so important to deprive your daughter of her dad....

skickens me to hear yet another story where the CMS are the key factor making the fathers life a misery and the mother is living a lavish lifestyle as a result.

Dont let the scum they call CMS win mate. hold on tight, it takes patience and determination.
keep a written record of everything, calls, names, dates etc copies, dont even throw a single payslip or p60 away, Organisation and record keep is essential to prevent these incompetent clowns robbing you of your hard earnt cash.

with regards to them using HMRC records , yes they do, however another part of their terms and conditions is that they will use the most recent tax years hmrc figures for calculation unless you can prove that your current wages is less than (or more than) 25% different. So if you changed jobs and earn less than your previous and the difference is greater than 25% then send in proof of 5 most recent payslips and a word of advice is when dealing with CMS, keep everything.

As long as you have proof of everything , so you have a case and can beat them dont give in. They gave me the run around for 9 months but in the end i got a result.

Now i keep all my payslips in shoe boxes dating back to when the cms case opened just in case they do try and magically create arrears.

dont deprive your child of a father over something that can be resolved.

contact your mp and write in a letter of complain detailing everything . the phone calls dont do anything from my experience, they are just call centre operators from the sound of it , who can barely use a computer .

And it is better to get the issues from 1 cms year dealt within that year as they get fussy and lazy about carrying it over to the next. see what the reply is from your written complaint, then you can take it to an independent complaint as.

If you still have no joy, i would consider contact bbc watchdog and the press as it appears the so called "new" and reformed CMS is just as bad or worse than the old CSA.

i have attached a copy of the leaflet about complaints etc

(which most of the CMS operators deny exists if you call them)

Thank you so much for that positive and moving advice you have given me, made me weep to read that people genuinely care, the pain in my heart is so heavy I cannot even begin to put in to words, I am 45 yrs of age have worked all my life never self employed, I never see my daughter as my exwife has poisioned her against after all she has the mind of a child so easy to corrupt with lies,

I have literally £3.20 in my wallet to live on for the week, and my bills are racking up to then point we're yet another debt is building up, which I have no control over, so many people out there like yourself is what keeps me going and I A my so grateful for your reply, will keep you up dated with any news, Sean wipes the tears from his eyes... thank you so much Sean.
