[Solved] Claiming maintenance when child was taken away

My partner revived a letter from child maintenance back in February last year stating that he had a child that was born in 2011. This turned out to be a one night stand he had. I was then contacted in March this year by her brother in law who told me that the social services had taken the child away from the mother due to child neglect (not the first time) since then we have both contacted CSA and reported this but as she is still claiming child benefits (illegally) the maintenance cannot be stopped? My parter pay around £630 a month to this woman. The child was put with her mother (grandmother) but the grandmother can't start claiming for child benefit as she herself claims benefits that will be stopped if it's seen she is well enough to look after a child full time? Her sister did have the child but she kicked off with social services to move her to another family member when they tried to claim child benefits?? We have already reported her to child benefit numerous times but nothing has happened?? We email/call CMS every other week to see if the child benefit has been stopped but nothing has yet? Can we claim this money back?? When it comes to light that the child isn't with the receiving mother?? We don't mind the child then getting most of the money into a saving accounts and the rest to the carer?? Any advice would be great. By the way he isn't on the birth certificate so has no legal rights for the child nor does he want any. Thank you

This all sounds like a complete mess.
.
I would contact your local MP and ask them to assist, give them all the details, the SS members name, the CSA advisors details and also the Child benifits team members details, I think you are possibly going to need somone who can make a difference and get something done, hopefully at worst the MP will be able to advise you of what to do if they can't help, though that said I would imagine they would be able to do something.

Thank you for replying. This woman doesn't live anywhere near us so not got a lot of details about her. I didn't realise MP's did anything like this?? All I do know is that one of her sisters works for the council in middlesborough so wouldn't want to go down that route as it wouldn't make a different if it reached their office. Any other recommendations would be greatful. Thank you

First, there is some mis information in been passed to you. Absolutely no other benefits are affected by claiming child benefit. (Disabled people are allowed to be parents. ) so the grandmother should be claiming it UNLESS the local authority is paying her for the upkeep of the child.

However, if it's a temporary messure while a child protection order goes through the courts, then mum can still claim child benefit and maintenance. BUT, if the local authority is paying for the care of the child (by paying the grandmother) then there is a reduction that can be applied to the maintenance payments.

If you google 'maintenance and local authority care' the . Gov website has a pdf that outlines the scales.
