Hi. I split with my wife back in August. And since then she got with some other guy that smokes crack and she is also doing it. At the beginning of August she was in bed and 3 of the kids got out and were going around the estate naked with sissies luckily they went to my brothers house, the police were called and they took my one year old to my sisters with me rest of the children who were not allowed contact with her for 5 days, until she sorted her house. (I was not with her at this time) I’ve had to go to the house a few times to get him out as he is shouting and screaming or violent toward her. My sister has been doing school runs and went to pick them up one morning and she was in bed and the kids had flooded the kitchen. (6.4,3,2 years old) we have been to social services for meetings but honestly there are not much help, we have a child protection meeting on Wednesday. Last weekend I was suppose to have the children but she’s gone! Left everything in her house hasn’t text I’ve text and called but nothing, there is an older child who is not mine who’s dad went to court and got temporary residency. I’m going out of my mind at the minute and just need some advice on where to start? Sorry for really long post. Thanks

Hi there

Have you called the police and reported them as missing? I’m assuming you’ve told the Social Services that she has left her address?

If you can locate their whereabouts you can make an emergency, no notice application to the court to have the children live with you... do you have the room to accommodate them?

You would need form C100 to apply for them to live with you and on the same form you can also ask for a Prohibited Steps Order to prevent them being removed from your care. You should also submit form C1a to tell the court about the risks to your children from her drug taking and neglect.

The cost to submit the application would be £215, unless you are on benefits or a low income, in which case you would be entitled to an exemption from the fee, to apply for that you would need form EX160a.

Once you’ve completed the forms, it’s best to take them to the court in person and explain to the office the need for you to be seen by the judge ASAP... tell them about the serious risks to your children, her drug taking, neglect and that she may disappear again at any time.arrive at court opening time, as you’re more likely to get seen.

I would also inform the social services what you intend to do and ask them for their support.
